AGREEMENT TO THESE TERMS
These Terms of Use constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and NextGen Modern Living (“NextGen,” “Company,” “we,” “us,” or “our”) concerning your access to and use of the website located at https://www.nextgenmodernliving.com/ (the “Site”), as well as any related content, forms, features, resources, products, communications, and services that link to these Terms of Use collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with all of these terms, you must discontinue your use of the Services.
Additional terms, policies, quotations, purchase agreements, project documents, financing agreements, delivery agreements, or other documents may apply to a particular product, transaction, or service. Those documents are incorporated into these Terms of Use when applicable. If a separate written agreement conflicts with these Terms of Use, the separate written agreement will control with respect to the subject matter it specifically addresses.
We may revise these Terms of Use from time to time. Changes will be reflected by updating the “Last updated” date above. Your continued use of the Services after revised terms are posted constitutes your acceptance of the updated Terms of Use.
The Services are intended for users who are at least 18 years old. Individuals under 18 may use the Services only with the involvement and supervision of a parent or legal guardian.
1. OUR SERVICES
NextGen Modern Living provides information about pre-designed prefabricated tiny-home models, available features, optional add-ons, packages, pricing, permit considerations, delivery, installation support, financing resources, and related services.
The Site is intended to help prospective customers learn about available models and contact NextGen for additional information or a project-specific quotation. Unless expressly stated otherwise in a signed written agreement, information presented on the Site does not constitute a binding offer, final quotation, construction agreement, purchase agreement, permit approval, financing commitment, or guarantee that a particular model can be placed or used on a specific property.
The Services are primarily intended for customers located in Arizona. Individuals accessing the Site from other locations do so on their own initiative and are responsible for complying with applicable laws in their jurisdiction.
2. PRODUCT POSITIONING AND INTENDED USE
NextGen offers pre-designed prefabricated models with approved options, packages, and available add-ons. NextGen does not represent that every model can be fully customized or redesigned according to each customer’s individual specifications.
The Site may describe potential uses such as guest space, office space, studio space, pool house, recreational space, retreat, accessory space, accessory dwelling unit, or similar secondary uses. These examples are provided for general informational and inspirational purposes only.
A reference to a potential use does not guarantee that the model may legally be placed, connected, occupied, rented, or used for that purpose on a particular property. The permitted classification and use of a unit depend on the property, jurisdiction, zoning, building codes, unit classification, certification, utility connections, HOA requirements, and other applicable restrictions.
No statement on the Site should be interpreted as a representation that a unit is automatically approved for use as a primary residence.
3. MODEL INFORMATION AND SPECIFICATIONS
We make reasonable efforts to present model images, floor plans, dimensions, specifications, features, materials, finishes, colors, capacities, pricing, and other information accurately.
However, photographs, illustrations, floor plans, three-dimensional renderings, virtual tours, videos, diagrams, and similar materials may be conceptual, representative, digitally enhanced, or based on a particular configuration. They may show optional upgrades, staging, furniture, landscaping, appliances, decorations, finishes, or features that are not included in the base model price.
Actual products may vary due to manufacturing changes, material availability, supplier changes, production methods, code requirements, design improvements, screen settings, photography, or other circumstances.
Dimensions and measurements may be approximate unless expressly confirmed in a final written agreement. Customers should not rely exclusively on website illustrations or measurements for site preparation, utility planning, foundation work, access planning, or permitting.
We reserve the right to modify, replace, update, or discontinue models, features, materials, configurations, packages, add-ons, specifications, and product information at any time.
4. PRICING AND QUOTATIONS
Prices displayed on the Site are provided for general informational purposes and may represent starting prices, base prices, estimated prices, or example configurations.
Unless expressly stated otherwise, displayed prices may not include:
- Optional add-ons or packages
- Sales or use taxes
- Permit fees
- Engineering or architectural services
- Site plans or surveys
- Utility connections
- Septic or sewer work
- Excavation, grading, drainage, or foundation work
- Delivery or transportation
- Cranes, specialized equipment, or access-related services
- Installation or setup
- Local inspections
- HOA fees or approvals
- Financing costs

Prices, availability, promotions, and specifications may change without notice.
A binding price will be established only through a written quotation, order document, purchase agreement, or other written agreement issued or approved by NextGen. A quotation may be subject to an expiration date, availability, site review, permit review, material pricing, manufacturing schedules, transportation requirements, and other stated conditions.
We reserve the right to correct typographical, pricing, calculation, or descriptive errors, including after information has been published or communicated.
5. REQUESTS FOR INFORMATION AND QUOTES
You may submit information through the Site to ask a question, request a quote, schedule a consultation, or discuss a model.
By submitting a form, you agree to provide accurate, current, and complete information. The submission of a form does not create a contract, reserve a unit, guarantee availability, establish a final price, or obligate NextGen to accept a project.
We may request additional information before preparing a quotation or determining whether we can assist with a project. This information may include:
- Property address
- City or county
- Parcel number
- Intended use
- HOA status
- Parcel maps
- Setbacks
- Preferred placement
- Utility requirements
- Septic or sewer information
- Site access conditions
- Other information relevant to the project
NextGen may decline to provide a quote or proceed with a project when required information is unavailable, the project appears unsuitable, the requested use may not be permitted, the location is outside the service area, or other circumstances prevent NextGen from reasonably providing the requested product or service.
6. PERMITS, ZONING, AND PROPERTY SUITABILITY
Permit and placement requirements vary by property and jurisdiction. Requirements may depend on factors including:
- City or county regulations
- Zoning classification
- Parcel size
- Property use
- Unit classification
- Setbacks
- Easements
- Access
- Utilities
- Septic or sewer requirements
- Floodplain or drainage conditions
- Fire access
- HOA rules
- Private covenants
- Intended occupancy
- Foundation or installation method
- Applicable certifications or building standards
NextGen may provide available materials, general guidance, or coordination support when local regulations allow a potential pathway for the selected unit.
However, NextGen does not guarantee permit approval, zoning approval, HOA approval, utility approval, installation approval, financing approval, or legal authorization for any specific use.
Final decisions are made by the applicable city, county, state agency, HOA, utility provider, lender, inspector, reviewing authority, or other third party.
You are responsible for confirming the requirements that apply to your property and intended use before purchasing a unit or beginning site work. Unless a separate written agreement expressly states otherwise, you are also responsible for obtaining all necessary permits, approvals, inspections, authorizations, and professional advice.
Permit-related services and expenses may be quoted separately based on the project’s specific requirements.
7. CERTIFICATIONS AND COMPLIANCE
The Site may reference certifications, standards, construction classifications, code pathways, or compliance objectives related to particular models.
Certification and compliance information may vary by model, configuration, production date, manufacturer, intended use, and jurisdiction. A certification applicable to one unit or classification may not apply to another unit, property, or intended use.
No certification or standard referenced on the Site eliminates the need for local review, permitting, inspections, zoning approval, or property-specific verification.
Customers should rely on the certification documents and specifications applicable to the actual unit being purchased, together with the requirements communicated by the relevant reviewing authorities.
8. DELIVERY, ACCESS, AND INSTALLATION
Delivery and installation requirements depend on the selected model, destination, transportation route, property access, terrain, weather, equipment requirements, permits, and site readiness.
Any delivery date or production timeline communicated before a final written agreement is an estimate only. Delivery and installation may be affected by circumstances outside NextGen’s reasonable control, including:
- Manufacturing schedules
- Material availability
- Transportation delays
- Road restrictions
- Weather
- Permit delays
- Inspection schedules
- Utility availability
- Site conditions
- Equipment availability
- Labor availability
- Government actions
- Natural events
- Other unforeseen circumstances
Customers are responsible for providing accurate information regarding access, placement conditions, utilities, grades, obstructions, overhead lines, gates, roads, turning areas, and other site conditions.
Additional costs may apply when specialized transportation, cranes, escorts, route modifications, grading, tree removal, utility relocation, access improvements, storage, redelivery, or other services are required.
Detailed delivery, site preparation, risk allocation, inspection, acceptance, and installation terms will be governed by the applicable written agreement.
9. SITE PREPARATION AND THIRD-PARTY WORK
Site preparation may require work performed by contractors, engineers, surveyors, architects, utility providers, septic professionals, excavation contractors, foundation contractors, installers, inspectors, or other third parties.
Unless a written agreement expressly states that NextGen is responsible for a particular service, NextGen is not responsible for:
- Selecting or supervising independent contractors
- The quality or timing of third-party work
- Site conditions
- Underground conditions
- Utility capacity
- Property boundaries
- Survey accuracy
- Soil conditions
- Drainage conditions
- Easements
- Setback compliance
- HOA compliance
- Work performed by a customer or third party
Customers should verify that contractors and professionals are properly qualified, licensed, insured, and authorized to perform the required work.
10. FINANCING INFORMATION
The Site may provide general information about financing options or may refer customers to third-party lenders or financing providers.
NextGen is not a lender unless expressly stated otherwise. Financing availability, rates, terms, payment amounts, eligibility, approval, and disclosures are determined exclusively by the applicable lender.
Any payment examples shown on the Site are illustrative only and may not reflect the terms available to a particular customer.
A referral to or mention of a lender does not guarantee approval and does not constitute financial, credit, tax, or legal advice. Customers should review the lender’s terms and obtain independent professional advice when appropriate.
11. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and its content are owned by or licensed to NextGen Modern Living.
This includes, without limitation:

- Model renderings
- Three-dimensional models
- Virtual tours
- Logos
- Trademarks
- Service marks

- Downloads
- Databases
- Software
- Source code
- Layouts
- Product names
- Marketing materials
These materials are collectively referred to as the “Content.”
The Content is protected by copyright, trademark, intellectual-property, unfair-competition, and other applicable laws.
Subject to your compliance with these Terms of Use, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, informational, and noncommercial purposes.
You may not, without our prior written permission:
- Copy or reproduce substantial portions of the Site
- Republish the Content
- Sell or commercially exploit the Content
- Modify or create derivative works from the Content

- You have the right to provide it.
- It does not violate another person’s intellectual-property, privacy, publicity, or contractual rights.
- It does not contain unlawful, threatening, defamatory, fraudulent, obscene, or harmful material.
- It does not contain malicious code or files.
Information submitted through forms or communications will be handled in accordance with our Privacy Policy.
Unless otherwise agreed in writing, general feedback or suggestions about the Services may be used by NextGen without restriction or compensation. This does not transfer ownership of confidential customer documents, property records, personal photographs, or other materials submitted solely for evaluating a project.

- Misrepresent a model’s certification, intended use, approval status, or relationship with NextGen
We may restrict or terminate access to the Services when we reasonably believe these terms have been violated.
15. THIRD-PARTY WEBSITES AND SERVICES
The Services may contain links to third-party websites, applications, manufacturers, builders, lenders, vendors, social-media services, mapping services, scheduling platforms, contractors, or other external resources.
NextGen does not control and is not responsible for third-party websites, services, policies, content, availability, security, accuracy, or practices.
A link, reference, or introduction does not necessarily constitute an endorsement or guarantee.
When you access a third-party service, you do so at your own risk and are subject to that third party’s terms and privacy policies. Transactions with third parties are solely between you and the applicable third party unless a written agreement expressly states otherwise.
16. PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy, available on the Site.
The Privacy Policy explains how we collect, use, store, and disclose information. By using the Services, you acknowledge that you have reviewed the Privacy Policy.
17. SERVICE MANAGEMENT
We reserve the right, but not the obligation, to:

- Restrict access to the Services
- Remove or disable content
- Correct errors
- Protect our rights, property, systems, employees, customers, and users

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE SITE AND GENERAL INFORMATION PROVIDED THROUGH IT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SITE WILL BE AVAILABLE WITHOUT INTERRUPTION
- WEBSITE INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT
- A PARTICULAR MODEL WILL BE AVAILABLE
- A DISPLAYED PRICE WILL BE THE FINAL PROJECT PRICE
- A UNIT WILL QUALIFY FOR A PARTICULAR LEGAL CLASSIFICATION
- A UNIT WILL BE APPROVED FOR A PARTICULAR PROPERTY OR USE
- A PERMIT, FINANCING APPLICATION, INSPECTION, OR HOA REQUEST WILL BE APPROVED
- A PROJECT WILL BE COMPLETED BY AN ESTIMATED DATE
- THIRD-PARTY SERVICES WILL MEET YOUR EXPECTATIONS
Nothing on the Site constitutes legal, zoning, engineering, architectural, financial, tax, real-estate, or other professional advice.
Customers should consult the appropriate qualified professionals and government authorities before making property, financing, construction, placement, or purchasing decisions.
Nothing in this section limits any express warranty or obligation included in a separate written agreement signed by NextGen.
21. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGEN AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.
THIS INCLUDES, WITHOUT LIMITATION:
- LOST PROFITS
- LOST REVENUE
- LOST DATA
- BUSINESS INTERRUPTION
- LOSS OF OPPORTUNITY
- COSTS INCURRED IN RELIANCE ON PRELIMINARY WEBSITE INFORMATION
- ACTIONS TAKEN BASED ON THIRD-PARTY CONTENT
- DELAYS OR INTERRUPTIONS OUTSIDE OUR REASONABLE CONTROL
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTGEN’S TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO NEXTGEN FOR ACCESS TO THE SITE.
Limitations applicable to a product purchase, delivery, installation, permit-support service, or other paid transaction will be governed by the applicable written agreement.
Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, these provisions will apply only to the maximum extent permitted by law.
22. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless NextGen and its owners, officers, employees, agents, affiliates, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from:
- Your misuse of the Services
- Your violation of these Terms of Use
- Your violation of applicable law
- Information or materials you submit
- Your infringement of another party’s rights
- False or misleading information provided by you
- Unauthorized use of the Content
We reserve the right to assume the exclusive defense of a matter subject to indemnification. You agree to reasonably cooperate with that defense.

Submitting an inquiry or requesting a quote does not, by itself, create a purchase agreement or authorize a transaction.
24. TERM AND TERMINATION
These Terms of Use remain effective while you use the Services.
We may restrict, suspend, or terminate your access to the Services when we reasonably determine that you have:

- Used the Services unlawfully
- Threatened the security or operation of the Services
- Infringed our rights or the rights of another person

26. INFORMAL DISPUTE RESOLUTION
Before filing a lawsuit concerning these Terms of Use or the Services, you and NextGen agree to make a reasonable, good-faith effort to resolve the dispute informally.
The party raising the dispute should provide written notice describing:
- The nature of the dispute
- The relevant facts
- The requested resolution
- Appropriate contact information
The parties will have at least 30 days after receipt of the written notice to attempt to resolve the matter before initiating formal proceedings, unless immediate relief is reasonably required or the applicable limitation period would expire.
This section does not prevent either party from seeking temporary or injunctive relief to prevent unauthorized use, infringement, misuse of intellectual property, security threats, or other immediate harm.
27. MISCELLANEOUS
These Terms of Use, together with the Privacy Policy and any applicable written agreements, constitute the entire agreement concerning your general use of the Services.
Our failure to enforce a provision does not waive our right to enforce it later.
If any provision is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
We may assign our rights and obligations under these Terms of Use as part of a merger, acquisition, restructuring, sale of assets, business transfer, or similar transaction.
You may not assign your rights or obligations under these Terms of Use without our written consent.
Nothing in these Terms creates an employment, agency, partnership, franchise, fiduciary, or joint-venture relationship between you and NextGen.
Headings are included for convenience and do not affect interpretation.
NextGen is not responsible for delays or failures caused by events beyond its reasonable control.
